1. INTRODUCTION
Welcome to FitSpirit Lifestyle Private Ltd (“FitSpirit,” “we,” “our,” or “us”). These Terms govern your access to and use of our website, mobile application, and all related online or offline services (“Services”). By accessing or using our Services, you agree to comply with and be bound by these Terms. If you do not agree, please do not use our Services. FitSpirit provides professional, science-based fitness, nutrition, and wellness solutions. Digital Consent: Your digital consent or continued use of our website/app shall be deemed acceptance under Section 10A of the Information Technology Act, 2000.

2. SERVICES PROVIDED
FitSpirit offers both online and offline fitness and wellness solutions:
1. Online One-on-One Personalized Workout Plans with Nutrition – Customized virtual training and nutrition guidance.
2. Offline One-on-One Personalized Workout Plans with Nutrition – In-person training with certified trainers.
3. Online Nutrition Plans – Personalized diet plans with tracking and feedback.
4. Online Group Yoga Classes – Instructor-led sessions focusing on flexibility, mobility, and mindfulness.
5. Single Experience Sessions (Online/Offline) – Paid trial sessions to experience FitSpirit services.
FitSpirit may modify, enhance, or discontinue services without prior notice.
3. USER ELIGIBILITY AND ACCOUNT
● You must be at least 18 years old.
● Provide accurate, complete, and updated information.
● Maintain confidentiality of your login credentials; account sharing is prohibited.
FitSpirit may suspend or terminate accounts that violate Terms or appear fraudulent.
4. PAYMENTS AND SUBSCRIPTIONS
● Payments are via secure third-party processors; FitSpirit is not liable for errors or delays.
● Subscriptions renew automatically unless canceled before the next billing cycle.
● All payments are non-refundable unless otherwise specified in exceptional cases.
5. CANCELLATIONS & RESCHEDULES
● Sessions require at least 12-hour notice for rescheduling.
● Missed sessions without notice are non-refundable.
6. REFUND POLICY
Payments are generally non-refundable. Refunds or credits are at FitSpirit’s discretion (e.g., duplicate payments, trainer unavailability).
7. HEALTH DISCLAIMER
● FitSpirit services are not medical advice.
● Always consult a healthcare professional before starting fitness/nutrition programs.
● Participation is at your own risk.
8. INTELLECTUAL PROPERTY
All content is owned or licensed to FitSpirit. Copying, modifying, or distributing without written consent is prohibited.
9. LIMITATION OF LIABILITY
FitSpirit is not liable for direct, indirect, or consequential damages from use of services or third-party failures.
10. TERMINATION OF SERVICES
FitSpirit may suspend or terminate access for misuse or violation of Terms. All rights granted to you cease upon termination.
11. GOVERNING LAW AND JURISDICTION
These Terms are governed by Indian law. Disputes will be subject to the exclusive jurisdiction of courts in India.
Optional Arbitration Clause:
In the event of any dispute, parties shall first attempt amicable resolution. Failing that, disputes will be referred to arbitration under the Arbitration and Conciliation Act, 1996, in [Bangalore, India], in English.

13. CUSTOMER CONDUCT
(a) Fitspirit prohibits discrimination against Service Professionals, including on the basis of race, religion, caste, national origin, disability, sexual orientation, sex, marital status, gender identity, age, or any other characteristic that may be protected under applicable law. Such discrimination includes but is not limited to any refusal to accept Pro Services based on any of these characteristics.
(b) We request that you treat all Service Professionals with courtesy and respect, and that you provide them with a safe, clean, and appropriate location to perform the Pro Services. Service Professionals shall be entitled to refuse to perform Pro Services if you have not provided a safe, clean, and appropriate location for them, or you behave towards them in a manner which is discourteous, disrespectful, abusive, or otherwise inappropriate. We reserve the right to withhold access to the Services and otherwise limit your access to Pro Services at our absolute discretion if you behave towards any Service Professional in a manner which is discourteous, disrespectful, or abusive, or which we otherwise deem to be inappropriate or unlawful.
(c) You agree that you will be liable for discriminating against Service Professionals or for any failure, intentional or otherwise, to provide the Service Professionals a safe, clean, and appropriate location for them to perform the Pro Services. Additionally, you will also disclose any and all information that may have a bearing on the ability of the Service Professional to perform the Pro Services or impact the Services Professional’s health, safety, or well-being, to UC and the Service Professional.
(d) You agree that in the event a Service Professional behaves in a manner that is discourteous, disrespectful, abusive, inappropriate, or in violation of the law, you shall be required to report such incident to info@fitspirit.co.in at the earliest but in any event within 48 (forty eight) hours of such incident.
